This notice is being published in accordance with Federal Acquisition Regulation (FAR) Subpart 5.101 requiring dissemination of information for proposed contract actions. This is a notice of intent to award a sole source purchase order, and is not a request for competitive quotes/proposals.
The Commodity Futures Trading Commission (CFTC) intends to award a purchase order to the Dow Jones & Company, Inc. on a sole source basis to renew digital access to the Wall Street Journal online subscription services for approximately 200 users. This requirement includes a 12-month base period and four (4) 12-month option periods. The base period of performance of the order will be September 24, 2023 through September 23, 2024.
Dow Jones & Company, Inc. is the only known source for these services and the CFTC is unaware of any alternative solutions. The Government intends to procure this requirement under FAR 13.106-1(b)(1) and 41 U.S.C. 3304(a)(1) – “the property or services needed by the executive agency are available from only one responsible source and no other type of property or services will satisfy the agency requirements.” THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE PROPOSALS nor a solicitation of offers. However, the Government will consider written responses from all responsible sources received by 12:00pm ET, June 30, 2023. Written responses must include sufficient information to establish capability to fulfill the requirement. Oral communications are not acceptable in response to this notice. Information received will be considered solely for the purpose of Market Research. A determination not to compete this requirement is solely at the discretion of the Government. No formal solicitation package is available. The Government will not be responsible for any costs of preparation in response to this announcement.
