Contract Opportunity

This is a public notice prepared in accordance with Federal Acquisition Regulation (FAR) 5.2 – Synopsis of Proposed Contract Actions.

The Library of Congress (LoC), Contracts and Grants Directorate (CGD), intends to issue two single-award, sole-source, firm-fixed-price (FFP) IDIQ contracts to: (1) Kodak (Eastman Kodak, 343 State St., Rochester, NY 14605) and (2) ORWO (Campbell Representation, 310 East Rd., West Stockbridge, MA 01266).

The period of performance for both intended contracts shall run as follows: one 12-month base year and one 12-month option year. Both contracts are valued at amounts below the simplified acquisition threshold (defined as $250,000 and below), but above $25,000 (the public notice threshold). These supplies will consist of the following: (1) Black-and-white fine grain print film stock, 35mm gauge; (2) Black-and-white fine grain duplicating negative film stock, 35mm gauge; (3) Black-and-white fine grain master positive film stock, 35mm gauge; (4) Color-print film stock, 35mm gauge; and (5) Color-intermediate film stock, 35mm gauge.

This announcement constitutes the only public notice, proposals are not being requested from other parties, and a written solicitation will not be issued. This public notice accomplishes the following:

1. Notice of the LoC’s intent to sole-source this requirement to the businesses listed herein;

2. Synopsizing the requirements in accordance with the FAR; and

3. Publicly posting the approved Justification and Approval (J&A) to the public in advance of the contract award rather than after award. As a result of this, a second posting of the J&A is not required after the award has been made.

As a result of this public posting, this shall be the only notice issued. A separate award notice and a separate J&A posting shall not be performed, as all public information is being accomplished via this public notice.

No further notices shall be pursued at this time regarding this contracting action.

Finally, the Library of Congress shall accept capability statements from other prospective businesses and review them for potential changes to its procurement direction. The LoC is not, however, obligated to change directions in this procurement without ample evidence.
