NOTICE OF INTENT TO AWARD A SOLE SOURCE
This Notice of Intent is not a request for competitive proposals. This is not a solicitation or request for offers.
The Forest Service intends to award a sole source award to ICF Incorporated, LLC to acquire Programmatic Environmental Impact Statement Services for 36 CFR 228A Revision Rulemaking (See attached J&A).
FAR 8.405-6(a)(1)(i)(C), In the interest of economy and efficency, the new work is a logical follow-on to an original order was placed in accordance with the applicable Federal Schedule ordering procedures.
ICF worked for this specific regulation revision effort from September 2019 to January 2021. During this performance period, ICF successfully produced a DRAFT PEIS, including internal USDA and OMB review procedures. ICF did not complete the PEIS due to changes in USDA administration and Agency priorities. Based on the unique mining law and related 228A regulation and policys and the required expitied delivery date; ICF is the only reasonable source to incorporate the changes to the proposed rule and move towards completing the environmental compliance to issue the revised 36 CFR 228 subpart A regulations. They have extensive understanding of the existing documents, administrative record, and will be able to move immediately forward. the next steps needed to complete this project.
Interested parties may identify their interests and capability to respond to this requirement by March 23,2023 at 3:00PM (EST). Any response to this notice must show clear and convincing evidence that competition would be advantageous to the Government.
Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. A determination by the Government not to compete this proposed award upon response to this notice is solely within the discretion of the Government. No reimbursement for any cost connected with providing capability information will be provided.
