The U.S. International Trade Commission has awarded a Blanket Purchase Agreement (BPA) on November 7, 2022, to Shaw, Bransford & Roth, P.C., a small business, Washington, D.C. In accordance with FAR Part 8, Required Sources of Supplies and Services, and specifically FAR 8.405-6(a)(A), an urgent and compelling need exists for equal employment opportunity (EEO) legal defense services. It was determined that by following normal competitive procedures would have resulted in unacceptable delays that would create significant liability for the Agency. This highly sensitive work requires immediate action because of pending litigation deadlines, actual conflicts of interest or lack of sufficient objectivity of Agency personnel, and a lack of other resources in-house to provide these services.

The determination not to compete this requirement is solely within the discretion of the government. The awarded Blanket Purchase Agreement’s estimated value is estimated to not exceed the Simplified Acquisition Threshold. The Limited Sources Justification is attached to this Notice.
